Terms of service
Terms of Service
Overview
Welcome to Ametelle.
These Terms of Service (“Terms”) apply when you visit, browse or make a purchase through the Ametelle online store (“Website”).
Throughout these Terms, “Ametelle”, “we”, “us” and “our” refer to Ametelle. “You” and “your” refer to the person accessing the Website or purchasing products from us.
By accessing our Website or placing an order, you agree to these Terms. Please read them carefully before making a purchase.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
---
1. Our Products
Ametelle specialises in handmade products, including crochet jewellery and accessories.
Because our products are individually handmade, there may be small variations between items, including variations in:
- crochet tension;
- shape and dimensions;
- positioning of individual elements;
- colour;
- pattern; and
- other handmade characteristics.
These variations are part of the handmade nature of our products and mean that each piece may be slightly unique.
We make reasonable efforts to display product colours and photographs accurately. However, colours may appear differently depending on lighting, photography, your device and your screen settings.
Any dimensions provided on our Website are approximate unless expressly stated otherwise.
---
2. Custom and Made-to-Order Products
Some Ametelle products may be customised or made to order, including different colours, colour combinations or other design details.
You are responsible for checking the customisation details provided with your order before submitting it.
Where we require further information to complete a customised order, production may not commence until that information has been provided.
Once production of a customised or made-to-order item has commenced, the order generally cannot be changed or cancelled simply because you have changed your mind.
This does not affect your rights under Australian Consumer Law where a product is faulty, damaged, incorrectly supplied or does not match the agreed specifications.
---
3. Orders
Submitting an order through our Website is an offer to purchase the products selected.
We reserve the right to accept or decline an order where reasonably necessary, including where:
- a product is unavailable;
- incorrect pricing or product information has been displayed;
- we are unable to fulfil a particular customisation request;
- we reasonably suspect fraudulent or unauthorised activity; or
- there has been an error affecting the order.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.
An order is not considered accepted until we have confirmed the order.
---
4. Pricing
All prices are displayed in Australian dollars (AUD) unless otherwise stated.
Prices may change from time to time. Any price change will not affect an order that has already been accepted, except where there has been an obvious pricing error.
Shipping costs and any other applicable charges will be shown during checkout before you complete your purchase.
Where a promotional code or discount is offered, any additional conditions applying to that promotion will be stated with the offer.
Discounts cannot be applied retrospectively unless we agree otherwise.
---
5. Payment
Payment must be made using one of the payment methods available at checkout.
You confirm that you are authorised to use the payment method provided for your order.
Orders may not commence production or be dispatched until payment has been successfully received or authorised.
Payment processing may be provided by third-party payment providers. Your use of those payment methods may also be subject to the payment provider's own terms and privacy practices.
---
6. Shipping and Delivery
We will make reasonable efforts to prepare and dispatch orders within the estimated processing times stated on our Website.
Because Ametelle products are handmade, processing times may vary, particularly for customised or made-to-order products.
Any delivery dates or timeframes provided are estimates unless expressly stated otherwise.
Delivery times may be affected by circumstances outside our reasonable control, including postal or courier delays.
Customers are responsible for providing a complete and accurate delivery address when placing an order.
If an order is returned to us because an incorrect or incomplete delivery address was provided, additional postage charges may apply before the order is resent.
Further information about delivery may be provided in our Shipping Policy.
Nothing in this section limits any rights you may have under Australian Consumer Law.
---
7. Returns, Refunds and Exchanges
Returns, refunds and exchanges are handled in accordance with our Refund & Returns Policy and Australian Consumer Law.
Our voluntary change-of-mind policy may contain exclusions for certain products, including customised or made-to-order products and earrings for pierced ears.
These exclusions do not limit your rights where a product is faulty, damaged, incorrectly supplied or otherwise fails to meet a consumer guarantee under Australian Consumer Law.
Please review our Refund & Returns Policy before placing your order.
---
8. Product Care and Use
Handmade crochet jewellery and accessories should be handled with appropriate care.
Where care instructions are supplied with a product or displayed on our Website, following those instructions can help maintain the appearance and condition of the item.
Normal wear and tear, accidental damage, misuse or damage resulting from care that is inconsistent with supplied care instructions will not necessarily constitute a product fault.
Nothing in this section excludes any rights or remedies available under Australian Consumer Law.
---
9. Jewellery and Small Parts
Some Ametelle products may contain small components, beads, crystals, chains, clasps, hooks or other decorative elements.
Unless expressly stated otherwise, Ametelle jewellery and accessories are not toys and should not be given to young children to play with.
Small components may present a choking hazard if detached. Products should be stored appropriately and kept away from babies and young children where relevant.
Customers with known sensitivities or allergies to particular jewellery materials should review the product information before purchasing and contact us if additional information about materials is required.
---
10. Website Information
We aim to ensure the information on our Website is accurate and up to date.
However, from time to time there may be:
- typographical errors;
- incorrect product information;
- pricing errors;
- availability errors; or
- other inadvertent mistakes.
Where we identify an error affecting an order, we will take reasonable steps to contact you and resolve the issue.
We may update or correct information on the Website when required.
---
11. Product Availability
As our products are handmade and may be produced in small quantities, availability can change.
Adding an item to your shopping cart does not reserve that item.
We may introduce, modify or discontinue products at any time.
Where an item becomes unavailable after you place an order and we are unable to supply it, we will contact you and provide an appropriate refund for the unavailable item.
---
12. Intellectual Property
Unless otherwise stated, the content of the Ametelle Website belongs to or is licensed to Ametelle.
This includes, where applicable:
- the Ametelle name and branding;
- logos;
- product photographs;
- graphics;
- product descriptions;
- text;
- crochet designs and original creative content; and
- Website content.
You may view the Website and save or print information for your own personal, non-commercial use.
You must not reproduce, republish, commercially exploit, distribute or use Ametelle content for another business without our prior permission, except where permitted by law.
---
13. Reviews, Photographs and Other Content You Submit
If you submit a product review, photograph, comment or other content to Ametelle, you confirm that:
- the content is genuinely yours or you have permission to provide it;
- it does not infringe another person's rights;
- it is not unlawful, misleading, abusive or defamatory; and
- it does not contain malicious software or harmful material.
Where you voluntarily provide content for publication, you grant Ametelle permission to display that content in connection with our Website and business.
We may choose not to publish or may remove content where reasonably necessary, including where it is unlawful, misleading, offensive, spam or unrelated to the relevant product.
We will not alter or suppress genuine customer reviews for the purpose of creating a misleading impression about our products.
---
14. Acceptable Use of Our Website
You must not use the Website:
- for unlawful or fraudulent purposes;
- to attempt to gain unauthorised access to the Website or related systems;
- to transmit viruses, malware or harmful code;
- to interfere with the security or operation of the Website;
- to collect information about other users without authority;
- to impersonate another person; or
- in any manner that violates applicable laws or regulations.
We may restrict access to the Website where reasonably necessary to protect Ametelle, our customers or the operation and security of the Website.
---
15. Third-Party Services and Links
Our Website may use or link to services operated by third parties, including payment providers, delivery providers, social media platforms or other external websites.
Third-party services operate independently of Ametelle and may have their own terms, conditions and privacy policies.
We are not responsible for the content or operation of independent third-party websites merely because our Website contains a link to them.
Nothing in this section limits any responsibility that Ametelle cannot lawfully exclude.
---
16. Consumer Guarantees
Products purchased from Ametelle come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Among other requirements, products must generally:
- be of acceptable quality;
- be fit for any disclosed purpose;
- match their description; and
- match any sample or demonstration model where applicable.
Depending on the circumstances, if a product does not meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy.
Nothing contained in these Terms, our Refund & Returns Policy or any other Ametelle policy is intended to remove or restrict these rights.
---
17. Liability
To the maximum extent permitted by law, Ametelle will not be liable for losses arising from circumstances outside our reasonable control or from misuse of a product.
However, nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law or other applicable legislation.
Where the law does not permit a particular limitation or exclusion of liability, that limitation or exclusion will not apply to the extent prohibited by law.
---
18. Privacy
When you place an order or use our Website, we may collect personal information necessary to process your purchase, provide customer service and operate our business.
Personal information is handled in accordance with our Privacy Policy.
By using our Website, you acknowledge that your personal information may be processed as described in that policy.
---
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, Website, products or applicable laws.
The version of the Terms published on our Website at the time you place an order will generally apply to that order.
Any updated Terms will take effect when published on the Website unless otherwise stated.
---
20. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the extent necessary, without affecting the remaining provisions.
---
21. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws of Australia.
Nothing in this section limits any rights you may have to bring a claim or exercise a remedy in another jurisdiction where those rights cannot lawfully be restricted.
---
22. Contact Us
If you have questions about these Terms, an order or an Ametelle product, please contact us using the contact details provided on the Ametelle Website.
We will make reasonable efforts to respond to customer enquiries and resolve genuine concerns promptly.
